Defendant Waymo LLC's motion to maintain the confidentiality designations of the videos produced under protective order is granted and its request for monetary sanctions is denied. Waymo met its burden of showing per the stipulated protective order that the videos that are the subject of this motion contain trade secret information and/or confidential, commercially sensitive proprietary information. The court credits the declaration of Chrix Finne which sufficiently establishes that the videos contain protectable information per the protective order. The Finne declaration is neither conclusory nor does it contradict Waymo's contention that the videos contain protectable information.
While unsuccessful, plaintiff Jennifer Hanki's challenge to the designation of the videos was made in good cause based on her not unreasonable intuitive argument that the videos do not contain protectable information because the vehicles' cameras are visible by an external inspection of the vehicles. Because Hanki did not lack good cause for her challenge to the designation of the videos, Waymo's request for monetary sanctions is denied per the terms of the protective order.

Counsel for the prevailing party is required to prepare a proposed order which repeats verbatim the substantive portion of the tentative ruling and must email it to contestdept302tr@sftc.org prior to the hearing even if the tentative ruling is not contested.
The court no longer provides a court reporter in the Law & Motion Department. Parties may retain their own reporter, who may appear in the courtroom or remotely.
