This is a collections case. Before the Court this day is an unopposed motion to deem RFAs admitted. The motion cannot be heard this day because the proof of service accompanying the motion contains the wrong address for defense counsel, arguably explaining why the motion is unopposed. In fact, upon close inspection, it appears that the discovery itself was mailed to the wrong suite number, which may explain the “radio silence” from defense counsel. It appears to this Court that plaintiff will have to start all over with this discovery effort.
