By participating in the first hearing, or electing not to attend after due notice, parties are deemed to have stipulated to the Commissioner serving as a Judge Pro Tem for the entire case. See CRC 2.816.

No appearance is necessary. This Court, having previously sustained the demurrer from all three defendants without leave to leave, no longer requires a CMC or further hearings. Defendants would probably be wise to eventually submit a proposed judgment, but that is of course up to them.
