ORDER RE: CASE MANAGEMENT

The Court has ordered the following after review of the case.

PARTIES SANCTIONED FOR FAILING TO COMPLETE MEDIATION

In the TRIAL SETTING ORDER dated MAY 20, 2025, the parties were ordered to complete mediation by JUNE 01, 2026. A CMC was set for JULY 20, 2026, for the express purpose of confirming that mediation had been completed.

CMC Statements indicates mediation has not yet been scheduled. No explanation was offered for the failure to abide by the Court’s Order.

Accordingly, as the TRIAL SETTING ORDER said could occur, each party is now sanctioned $500 for failure to complete mediation as ordered. Sanctions are due in full on the first day of trial. However, if Mediation is completed or a Notice of Settlement is filed before the Mandatory Settlement Conference now set for SEPTEMBER 02, 2026, at 9 am in Dept 301, the sanctions will be vacated.

THE MANDATORY SETTLEMENT CONFERENCE set for SEPTEMBER 02, 2026, at 9:00 am in Dept. 301 IS MAINTAINED. The parties are reminded that WRITTEN SETTLEMENT CONFERENCE STATEMENTS setting forth a GOOD FAITH ANALYSIS of the facts, the law and a GOOD FAITH OFFER to resolve this case from each party must be emailed directly to dept302@alameda.courts.ca.gov. All trial counsel, parties, and insurance adjusters or others with full settlement authority must participate in person.

The JURY TRIAL date of OCTOBER 23, 2026, is MAINTAINED.

The Court is currently conducting fully in person, live jury trials. Please carefully review the TRIAL SETTING ORDER issued in this case and fully comply with its pretrial orders and deadlines.
