Notice is insufficient. Notice of Hearing (GC-020) served by mail on 04/28/25 to Yolanda Abaca, maternal grandmother. Ileana Tocuseanu, paternal grandmother, was not served but is required to be served. However, she appears to have been the person effectuating service. (See Proof of Service attached to GC-010) Service by mail is required to all relatives within the second degree, and personal service is required to the proposed wards. The proposed wards were not served. 15 days notice is required. (Probate Code §1511)
The court intends to continue the hearing for statutorily sufficient service of the Notice of Hearing (GC-010) to the proposed wards and Ileana Tocuseanu.
Upon statutorily sufficient service of notice, the court intends to grant the petition and appoint Reggiena Dino Abaca guardian of the estate of Aubrey Nicole Tocuseanu and Mason Miles Tocuseanu with deposit of funds in blocked account.
