Capacity Declaration (GC-335) Filed 10/10/25 and 04/09/26. Completed by Anders Waalen, MD is insufficient. Dr. Waalen fails to conclude if the proposed conservatee lacks the capacity to has the capacity to give informed consent to any form of medical treatment or specific medical treatment. (See #20 and #21) The capacity declaration states it was signed by JENNY SIU YEE LI MD. M.D. and then Anders Waalen, M.D. 09/04/25 is typed on the date line.
Petitioner to file a statutorily sufficient Capacity Declaration on or before 08/07/26.
The petition lists the value of the estate at $100 plus Social Security. The requested powers all discuss a condominium. Does proposed conservatee own an interest in a condominium? If the assets is owned by proposed conservatees SNT, there are no powers re the condominium available in this conservatorship as the condominium is not a part of the conservatorship estate.
Further, the powers requested at attachment #1.i. do not state the authority for the requested powers. If the requested powers are pursuant to Probate Code §2591, petitioner has failed to provide facts sufficient to grant such powers (see Probate Code §2590(a)).
The court intends to continue the hearing to 08/14/26 at 9:00 a.m. in Department J6.
