Motion of Plaintiff Jennifer Garcia to Consolidate Related Actions for All Purposes (“Motion”):
Plaintiff Jennifer Garcia moves to consolidate, for all purposes, this action with the related wrongful death action, Berenice Perez Ramirez, et al. v. Bakhtiyor Khushmamadov, et al., Case Number 25CV006558, pursuant to Code of Civil Procedure section 1048(a). The Motion is unopposed.
The two actions arise from the same motor vehicle collision and involve common issues of law and fact. Consolidation of the two actions would promote judicial economy while ensuring that the wrongful death claims are adjudicated in a single action. (See Smith v. Premier Alliance Ins. Co., (1995) 41 Cal.App.4th 691, 697.) Accordingly, the court GRANTS the Motion. However, the cases shall be consolidated under the earlier filed case. Therefore, the lead case is Case Number 25CV006558.
Plaintiff shall prepare the court’s order consistent with this tentative ruling. The parties are ordered to meet and confer regarding a case management schedule and submit a joint status report prior to the Order to Show Cause and Case Management Conference scheduled for July 28, 2026, in Department 15.
