Defendant’s Motion to Compel Non-Party’s Compliance with Subpoena and for Sanctions

PARTIES TO APPEAR on the unopposed motion of Defendant Xiaolan Liu (“Defendant”) to compel non-party Defense Language Institute Foreign Language Center (“DLI”) to comply with the Court’s February 6, 2026, order, and for sanctions.
At the June 26, 2026, Trial Management Conference, defense counsel notified the Court that DLI has produced documents but asked to keep the motion scheduled for July 10th until DLI submits an executed Affidavit of Custodian of Records. [Evid. Code § 1561.] As of now, Defendant has not updated the Court on whether DLI has provided the requested affidavit or if the motion remains unresolved.
If the motion remains ready for resolution, the Court will issue a Tentative Ruling at the hearing. Otherwise, Defendant should promptly notify the Court and counsel, preferably before the hearing, so the Court can vacate it.
