CODE SECTION 2107 13 TENTATIVE RULING 14 Having read and considered the pleadings, declarations, and other evidence submitted in this matter, the 15 Court makes the following findings and orders: 16 A. Procedural History 17 1) Petitioner Adriana Cerros (Wife) and Respondent Carlos Flores (Husband) married on 3/27/1997. 18 The parties agree they separated on 9/16/2023, for a marriage of 26 years and 5 months.
The 19 parties have no minor children. Both parties are self-represented, although Wife has a consulting 20 attorney, Kristina Asuncion. 21 2) On 11/8/2023, in related Case No. FDV-23-817110, Wife obtained a Domestic Violence 22 Restraining Order After Hearing against Husband. The restraining order expires on 11/8/2026. 23 3) On 3/4/2025, Petitioner filed a Declaration Regarding Service of Preliminary Declaration of 24 Disclosure. 25 4) There have been no orders made in the FDI case to date. 26 5) On for hearing is Wife’s Request for Order filed 5/14/2026 asking that the Court grant Wife’s 27 voluntary waiver of Husband’s Preliminary and Final Declarations of Disclosure and to preclude 28 Husband from presenting evidence on issues that should have been covered in those declarations. 29 Wife further requests that the Court enter her proposed Judgment of Dissolution.
Wife states that
1 on 3/24/2025, she received a copy of Husband’s Response to the Petition, Community Property 2 Declaration, and Income and Expense Declaration, but the packet “did not include a complete set 3 of documents in support of the statements in the community property declaration.” Wife states 4 that, to date, Husband has not served his completed and signed Preliminary Declaration of
5 Disclosure. Wife writes, “I believe he is doing this to control me and because he believes that I 6 will go back to him.” Wife included a declaration of her consulting attorney Kristina Asuncion 7 wherein Ms. Asuncion states that Husband insists he has already completed financial disclosures 8 and has refused to provide the requested supporting documents. 9 6) Per the Proofs of Service filed 5/14/2026 and 6/17/2026, Wife’s Request for Order and the
10 Tentative Ruling Instructions were mailed to Husband on 6/15/2026. 11 7) Husband did not file a Responsive Declaration. 12 B. Findings and Order 13 1) The Court will give Husband a final opportunity to present the missing documents. No later than 14 Friday, 7/24/2026, Wife shall present to Husband a list of documents that are missing from

15 Husband’s Preliminary Declaration of Disclosure as required by Family Code section 2104. No 16 later than Friday, 8/21/2026, Husband shall provide to Wife the documents requested by Wife. 17 2) The hearing on Wife’s Request for Order filed 5/24/2026 is continued to Thursday, 10/1/2026 at 18 9:00 AM in Dept. 404. 19 3) At least 20 calendar days prior to the next hearing date, Wife shall file and serve a declaration
20 (not to exceed 5 pages in length, not including exhibits) to which she attaches a true and correct 21 copy of the list of documents she requested that Husband provide. Wife shall also provide an 22 update to the Court regarding whether Husband provided the requested documents and which 23 documents, if any, are missing. 24 4) At least 10 calendar days prior to the next hearing date, Husband may file and serve a declaration
25 (not to exceed 5 pages in length, not including exhibits) wherein he responds to any new 26 declaration filed by Wife. 27 5) Wife’s request that the Court enter her Judgment of Dissolution at this juncture is denied. If the 28 parties are unable to reach a stipulated agreement, either party may file an At Issue Memorandum 29 to request a Mandatory Settlement Conference and future trial date.
