PLAINTIFF PAUL MCGRATH Notice Of Motion And Motion To Invalidate And Expunge Lien; And For Orer To Release Funds Held In Trust; is GRANTED.
Notice of Lien filed on June 25, 2025 does not comply with CCP 708.410(b). The Court does not reach the issue whether another Notice of Lien could be effective as there is no such Notice of Lien on file contrary to the claim made in opposition that a Notice of Lien was filed on March 4, 2026.
March 4, 2026 filing was rejected on March 5, 2026 at 1:23 p.m. and never re-submitted. On March 4, 2026 a Notice of Judgement was filed. This filing did not contain an "abstract or certified copy of the judgment creditor's money judgment." It appears to include an uncertified copy of a judgment in case CGC-23-606347. The proof of service for the Notice of Judgment purports to have been served on the Plaintiffs only "via email" to a street address. =(501/CFH)
