This matter is on calendar for a Petition to Remove Administrator and Appoint Surviving Daughter as Administrator. Petitioner Lenora Pesetti seeks to remove the Shasta County Public Administrator as personal representative. No Notice of Hearing was filed on the Petition to Remove Administrator. Additionally, the Petition was not verified as required by Probate Code Section 1021. The Petition is therefore procedurally defective and is DENIED on those grounds. As a separate and independent grounds for denial, the Court finds that the Petition does not establish grounds for removal. The Petition fails to identify any grounds for removal enumerated in Probate Code Section 8502. The Petition also fails to justify removal under Probate Code Section 8503 on the grounds that the Petitioner had actual notice and an opportunity to contest the appointment of the current Administrator. The Petition is DENIED on the merits as well.

This matter is also on calendar for a Petition for Letters of Administration filed by Lenora Pesetti. This Petition is combined with the above Petition to Remove Administrator. This matter has not been properly noticed. The Notice of Petition to Administer Estate filed on April 2, 2026, is defective. It fails to identify the date and place of mailing. Regardless of the notice issue, Petitioner has failed to establish grounds for removal as noted above. The Petition is DENIED due to lack of notice and on the merits for failure to establish grounds to remove the current administrator.

Finally, this matter is on calendar for confirmation of filing of the Inventory and Appraisal. A Final Inventory and Appraisal was filed on January 29, 2026, and is accepted by the Court. This matter is set for Status of Administrator on Monday, December 21, 2026, at 2:30 p.m. in Department 44. The Personal Representative is ORDERED to comply with Probate Code Section 12200 et seq. No appearance is necessary on today’s calendar.
