LAW AND MOTION TENTATIVE RULINGS 9:01 A.M. LINE 1 22CV402055 VolumeFi Hearing: Pro Hac Vice Counsel Software, Inc. vs On April 21, 2026, Plaintiff VolumeFi Software filed this application of Zaki Manian Kyle Roche to be admitted as pro hac vice.
Defendant Zaki Manian opposes the application filed opposition papers on April 22, 2026 on two grounds: (1) Defendant asserts that this Court lacks jurisdiction as the defendant filed an appeal with respect to an order denying a special motion to strike. The Sixth District Court of Appeal filed an entry of decision on February 27, 2026, and the decisions becomes final in thirty days on March 29, 2026. Per Defendant, the remittitur will not issue from the court of appeal until thirty days from the date of decision, on May 28, 2026; and (2) that Kyle Roche has a conflict of interest in this matter.
The Court received that the Sixth Appellate District filed a remittitur on May 1, 2026.
On April 21, 2026 Plaintiff filed an application for pro hac vice renewal to June 2, 2026. On April 30, 2026, Plaintiff filed a proposed order regarding a pro hac vice application of Roarke Maxwell that was not accompanied by moving papers for the same June 2, 2026 dates.
This hearing is CONTINUED to the already reserved hearing date of June 2, 2026 at 9:01a.m. in Department 1. Parties to comply with Code of Civil Procedure 1005 regarding papers and oppositions.
