DEFENDANT DEMURRER to COMPLAINT is OVERRULED. C.C.P. 1161(4) is the proper standard to calculate the expiration of the Three-Day Notice, as the eviction was for reasons of nuisance and refusal of landlord's entry. Accordingly, the Complaint was not filed prematurely. Further, the Notice stated the notice period clearly and was not deficient. =(501/CFH)
