DEFENDANT BRIAN ZHU Notice Of Motion And Motion To Vacate Judgment is DENIED. Defendant failed to present any facts demonstrating that the Judgment taken against him was through his mistake or excusable neglect. (C.C.P. 473(b).)
Defendant's argument that he was confused by the "et al" designation is undermined by the fact that he filed an Answer to the Complaint and does not dispute that he received Notice of Time and Place of Trial that clearly stated that trial was set for January 26, 2026 and that "all parties MUST appear on the date of trial. Defendant fails to clearly explain why he did not inquire into the date on the Notice or why he failed to appear. =(501/CFH)
