Set for Law and Motion/Discovery Calendar on Tuesday, May 12, 2026, Line 5. Plaintiffs and Cross-Defendants Brenda Jackson and Pearlie James' Motion For Judgment On The Pleadings As To Cross-Complaint is OFF CALENDAR.

Cross-defendants seek judgment on the pleadings per Code of Civil Procedure section 438. Code of Civil Procedure section 439(a) requires that the parties shall "meet in confer in person, by telephone, or by video conference" prior to filing the motion. Section 439(a)(3) also requires movant to provide a "declaration" regarding the meet and confer efforts. Here, Moving Cross-Defendants have not demonstrated compliance with section 439's requirements, The Diggs declaration documents email correspondence only, which is non-compliant. The court issued a similar order in June 2025 in this case. The parties are ordered to comply with the code.

The court notes that purported oppositions filed before the moving papers will not be considered. The parties must follow the rules regarding submission of motions-related papers. Moving Cross-Defendants are ordered to prepare a proposed order consistent with the above and email it to contestdept302tr@sftc.org prior to the time set for hearing.

The text of the email shall include the name and contact information, including email address, of the attorney or party who will appear at the hearing.

The court no longer provides a court reporter in the Law & Motion Department. Parties may retain their own reporter, who may appear in the courtroom or remotely. A retained reporter must be a California certified court reporter (CSR), for only a CSR's transcript may be used in California courts.
