Ruling

Set for Law and Motion/Discovery Calendar on Tuesday, May 12, 2026, Line 1. The Status Conference re: Final Accounting is CONTINUED TO MAY 6, 2027, AT 9:00 AM IN THIS DEPARTMENT.

Plaintiff's counsel must file a declaration re disposition of settlement proceeds and any other outstanding issues that may be discussed at the hearing, with appropriate evidentiary support, no later than ten court days before the continued hearing, with courtesy copy provided to this department within 24 hours of filing. If all funds have not been accounted for and distributed by the date of the status report, all counsel shall appear in person at the May 6, 2027 hearing.

It appears Plaintiff is in violation of a court order. In connection with the February 10, 2026 hearing, the court ordered the following: "Plaintiff is ordered to prepare a proposed order consistent with the above and email it to contestdept302tr@sftc.org prior to the time set for hearing." Further, a similar directive is set out in Local Rule 2.7. Three months later, the court is without the proposed order.

Plaintiff is ordered to submit a proposed order quoting verbatim the tentative ruling for the 2/10/2026 hearing; the proposed order must be emailed to contestdept302tr@sftc.org no later than 8:30 am on 5/11/2026. Additionally, it appears-as was so in connection with the 2/10/2026 hearing-Plaintiff violated the court's order directing him to promptly deliver to the department a courtesy copy of the report filed in connection with the hearing. Plaintiff must comply and confirm receipt. Subsequent violations of written orders will result in an OSC and an order requiring counsel to appear in person to explain their failure to comply.

Plaintiff is ordered to prepare a proposed order consistent with the above and email it to contestdept302tr@sftc.org prior to the time set for hearing. TO BE CLEAR, PLAINTIFF IS TO SUBMIT PROMPTLY TWO PROPOSED ORDERS.

For the 9:00 a.m. calendar, all attorneys and parties may appear in Department 302 remotely or in person. Remote hearings will be conducted by videoconference using Zoom. (Dept. 302 Zoom ID 160 409 7690; Passcode 516287.) To appear remotely at the hearing, go to the court's website at sfsuperiorcourt.org under "Online Services," navigate to "Tentative Rulings," and click on the appropriate link, or dial the corresponding phone number.

Any party who contests a tentative ruling must send an email to contestdept302tr@sftc.org with a copy to all other parties by 4pm stating, without argument, the portion(s) of the tentative ruling that the party contests. The subject line of the email shall include the line number, case name and case number. The text of the email shall include the name and contact information, including email address, of the attorney or party who will appear at the hearing.

The court no longer provides a court reporter in the Law & Motion Department. Parties may retain their own reporter, who may appear in the courtroom or remotely. A retained reporter must be a California certified court reporter (CSR), for only a CSR's transcript may be used in California courts. If a CSR is being retained, include in your email all of the following: their name, CSR and telephone numbers, and their individual work email address. =(302/JMQ) |
