PLAINTIFF EMA BELL's Motion To Approve Proposition 65 Settlement And Consent Judgment. Plaintiffs' unopposed Motion to Approve Proposition 65 Settlement and for Entry of Consent Judgment is GRANTED.
Having reviewed the moving papers, the supporting declarations, and the revised Consent Judgment, the court finds that the injunctive relief required by the settlement complies with Proposition 65; the civil penalty amount is reasonably based on the criteria set forth In Health & Safety Code Section 25249.7(b)(2); and the attorneys' fees and costs awarded pursuant to the terms of the settlement are reasonable under California law.
Plaintiff is ordered to submit a new Proposed Consent Judgment executed by all parties AFTER the revisions to Sections 3.2, 5.1, and 14.1 were made and agreed upon.
For the 9:00 a.m. calendar, all attorneys and parties may appear in Department 302 remotely or in person. Remote hearings will be conducted by videoconference using Zoom. The text of the email shall include the name and contact information, including email address, of the attorney or party who will appear at the hearing.
Counsel for the prevailing party is required to prepare a proposed order which repeats verbatim the substantive portion of the tentative ruling and must email it to contestdept302tr@sftc.org prior to the hearing even if the tentative ruling is not contested.
The court no longer provides a court reporter in the Law & Motion Department. Parties may retain their own reporter, who may appear in the courtroom or remotely. A retained reporter must be a California certified court reporter (CSR), for only a CSR's transcript may be used in California courts.
