Defendants Alight Solutions, LLC and Reed Group, LLC's unopposed Motion to Admit Counsel Eric P. Mathisen Pro Hac Vice is DENIED WITHOUT PREJUDICE.

Counsel Eric P. Mathisen has failed to declare '[t]he title of each court and cause in which the applicant has filed an application to appear as counsel pro hac vice in this state in the preceding two years, the date of each application, and whether or not it was granted." (See Cal. Rules of Court, rule 9.40(d)(5).) Counsel declares he "ha[s] not applied for appearance or appeared pro hac vice in any other matters in the state courts of California in the last two years." Counsel's testimony begs the question whether he has applied to appear PHV in any other court, including any federal court, in this state?

The clear intent of the requirement is to assure the court counsel is not seeking to appear PHV with such frequency that they should seek admission to the State Bar rather than PHV status. On this record the court cannot make the necessary determination.

The court no longer provides a court reporter in the Law & Motion Department. Parties may retain their own reporter, who may appear in the courtroom or remotely. A retained reporter must be a California certified court reporter (CSR), for only a CSR's transcript may be used in California courts.
