DEFENDANT ALVIN WILLIAMS DEMURRER to Amended COMPLAINT is SUSTAINED in part, with leave to amend within 5 days of notice of entry of order to attach the complete lease agreement that forms the basis of the complaint, including any addenda or attachments thereto.
On the face of the First Amended Complaint, there are several addenda to the written lease, which were attached and incorporated into the lease, and are therefore all parts of the whole agreement. The demurrer is sustained on this basis only, and is otherwise overruled. The Court notes that while Defendant asserts there are at least 19 different addenda, paragraph 28 of the lease attached to the First Amended Complaint expressly identifies only 15 such addenda. =(501/CFH)
