Matter on calendar for Friday, March 13, 2026, Line 14, PLAINTIFF ABDALLAH ELHANIA, ZAHRA ELMENJAOUI's Motion To Compel Airbnb, Inc. And Airbnb Payments, Inc.'s Further Responses And Compliance To Request For Production Of Documents Set Three And For Sanction. To be heard at 1:00 pm by Judge M. True.
Plaintiff's motion to compel the AIRBNB defendants to provide further responses to the Requests for Production (Set 3) ("RFP") is GRANTED and DENIED IN PART.
The motion is GRANTED as to RFP 45, 46, 57, 58. The motion is GRANTED as to RFP 73, 74, 75, 76 but is limited to the Sunnyvale ordinance or Sunnyvale. The motion is GRANTED as to RFP 77, 78 to clarify that all documents have been provided (CCP 2031.220.) These requests pertain to Sunnyvale's short term rental ordinance and are reasonably calculated to lead to the discovery of admissible evidence. (CCP Section 2017.010.) Defendants fail to show the requests are unduly vague or burdensome. Defendants must produce their documents, if any. For the responses to which AIRBNB is claiming a privilege, AIRBNB shall produce a privilege log.
The motion is DENIED as to RFP 47-56, 59-72. The requests relate to cities, municipalities, etc. that have no relation to this case. The requests are not reasonably calculated to lead to the discovery of admissible evidence. The court further notes that many of the requests are facially overbroad and burdensome. (See, e.g., RFP 55.)
For the 1:00 p.m. calendar, all attorneys and parties may appear in Department 302 remotely or in person. Remote hearings will be conducted by videoconference using Zoom. The subject line of the email shall include the line number, case name and case number. The text of the email shall include the name and contact information, including email address, of the attorney or party who will appear at the hearing.
Counsel for the prevailing party is required to prepare a proposed order which repeats verbatim the substantive portion of the tentative ruling and must email it to contestdept302tr@sftc.org prior to the hearing even if the tentative ruling is not contested.
The court no longer provides a court reporter in the Law & Motion Department. Parties may retain their own reporter, who may appear in the courtroom or remotely. A retained reporter must be a California certified court reporter (CSR), for only a CSR's transcript may be used in California courts. If a CSR is being retained, include in your email all of the following: their name, CSR and telephone numbers, and their individual work email address. =(302/JMT). | |
