Motion – Discovery – Discovery Facilitator Program
Plaintiff Charles Norman (“Plaintiff”) filed a motion to compel further discovery responses to requests for production of documents, special interrogatories, form interrogatories, and requests for admission. Plaintiff asserts that he received boilerplate objections and incomplete or evasive responses. Plaintiff also requests monetary sanctions, although a pro per litigant may recover costs, but not attorney fees incurred in bringing a discovery motion. (Aragam v. Ratan (1999) 73 Cal.App.4th 1173, 1180.)
The parties were recently referred to Discovery Facilitator Michael Lopez for potential resolution of the discovery dispute. The court shall continue this motion to August 5, 2026 at 1:30 pm to allow the parties to meet with the facilitator per local rule MCR 2.13. In the event the matter is not resolved, the parties shall file a Declaration of Non-Resolution in conformity with the local rule MCR Civ. 2.13H.
All parties must comply with Marin County Superior Court Local Rules, Rule 2.10(B) to contest the tentative decision. Parties who request oral argument are required to appear in person or remotely by ZOOM. Regardless of whether a party requests oral argument in accordance with Rule 2.10(B), the prevailing party shall prepare an order consistent with the announced ruling as required by Marin County Superior Court Local Rules, Rule 2.11.
