Tentative Ruling:
To continue the hearing to August 11, 2026 at 3:30 p.m. in Department 502. Defendant to file a proof of service of the moving papers to plaintiff’s new address by July 10, 2026. The deadlines to file opposition and reply shall be based on the new hearing date of August 11, 2026.
Explanation:
The court received a letter indicating plaintiff’s address is now California Men’s Colony State Prison, PO Box 8101, CDC 6288, San Luis Obispo, CA 93409-8010. It is unclear from the letter when the plaintiff’s address changed or whether defendant was provided notice of the change of address. In order to ensure plaintiff has the opportunity to review and oppose defendant’s Motion for Judgment on the Pleadings, the hearing on the motion is continued to August 11, 2026 for defendant to serve plaintiff at his current address. The deadlines for opposition and reply shall be based on the new hearing date.
Pursuant to California Rules of Court, rule 3.1312(a), and Code of Civil Procedure section 1019.5, subdivision (a), no further written order is necessary. The minute order adopting this tentative ruling will serve as the order of the court and service by the clerk will constitute notice of the order.
