19 A. Procedural History 20 1) Petitioner Karishma Bery (Mother) and Respondent Parakram Khandpur (Father) have one minor 21 child together, M.B. (DOB: 12/6/2016, age 9). 22 2) On 12/10/2025, Mother filed a request for Domestic Violence Restraining Order (DVRO). On 23 12/24/2025, the Court granted a Temporary Restraining Order (TRO) against Father with Mother 24 and M.B. as protected parties. The TRO expires on 7/16/2026. 25 3) On 12/24/2025, the Court filed a Stipulation and Order wherein the parties agreed to amend the 26 TRO, continue using Talking Parents for brief and peaceful contact regarding Father’s parenting 27 time, and set forth Father’s parenting time with M.B., as follows: Commencing 12/27/2025, 28 Father shall have every Saturday from 10AM to 6PM (with one exception for 1/17/2026); 29 commencing 1/7/2026, Father shall have M.B. every Wednesday after school until 8:30PM and
1 ensure M.B. completes her homework while in his care; on Wednesdays, Father shall pick up the 2 vehicle by 3PM to pick M.B. up from school; Father shall provide proof of completion of his 3 Positive Parenting Program (Triple P) and Open Path Collective’s 12-hour Anger Management 4 Course by 1/5/2026. 5 4) On for hearing is Father’s 4/14/2026 Request for Order seeking joint legal and physical custody. 6 5) At a 4/15/2026 hearing on Mother’s DVRO request, the Court set the domestic violence matter 7 for trial on 7/15/2026 and 7/16/2026 at 1:45PM in Dept. 404. 8 6) On 5/18/2026, the Court ordered both parties to attend orientation and mediation with Family 9 Court Services and set a hearing for 6/30/2026 at 9AM in Department 404 in case no agreement 10 was reached in mediation. 11 7) On 5/19/2026, both parties attended mediation and were unable to reach an agreement. 12 8) On 6/22/2026, Mother filed a Responsive Declaration to Father’s 4/14/2026 Request for Order. 13 9) On 6/23/2026, Father filed two witness declarations in support of his 4/14/2026 Request for 14 Order as well as a Reply Declaration. 15 B.
Findings and Orders 16 1) This Court has jurisdiction to make child custody orders in this case under the Uniform 17 Child Custody Jurisdiction and Enforcement Act. A violation of this order may subject the party 18 in violation to civil or criminal penalties, or both. The country of habitual residence of the minor 19 child is the United States. 20 2) The parties are ordered to appear in person or via Zoom video at 9AM on 6/30/2026 in 21 Department 404. 22
