Defendant Volkswagen Group of America, Inc.'s motion to compel plaintiff to present her vehicle for inspection in California is denied. The vehicle is currently in Massachusetts. There is no suggestion that plaintiff Kimberlie Hatch moved it to Massachusetts to evade any discovery obligation, nor was Hatch required to notify Volkswagen before she moved. A party may designate a location for inspection in its demand for inspection, but the location must be reasonable. (Code Civ. Proc., sec. 2031.030, subd. (c)(3).) A demand to inspect the vehicle in California is not reasonable where the vehicle is currently in Massachusetts. Nor is there any provision in the Code for Hatch to be required to pay the cost of Volkswagen's inspection in Massachusetts. No sanctions are awarded; both parties' positions have substantial justification.
For the 9:00 a.m. calendar, all attorneys and parties may appear in Department 301 remotely or in person. Remote hearings will be conducted by videoconference using Zoom. The text of the email shall include the name and contact information, including email address, of the attorney or party who will appear at the hearing.
Counsel for the prevailing party is required to prepare a proposed order which repeats verbatim the substantive portion of the tentative ruling and must email it to contestdept301tr@sftc.org prior to the hearing even if the tentative ruling is not contested.
