PLAINTIFF'S MOTION FOR LEAVE TO FILE FIRST AMENDED VERIFIED COMPLAINT is GRANTED, provided that Plaintiff makes the following further adjustments to the amended pleading prior to filing: First, either add an allegation reflecting the specific facts provided in the second sentence of Paragraph 4 of the Declaration of M. Ryan Pinkston filed in support of this motion, or add as a co-plaintiff the current owner of the property, or both. Second, if Plaintiff contends that Defendants are currently in possession, or claim a right to possession, of the property, expressly allege as much, and exclude any Defendants not so contended from this unlawful detainer action; or alternatively, if Plaintiff does not contend that any Defendant is currently in possession of the property, amend pursuant to Civil Code 1952.3.
The Court makes no determination at this time as to the sufficiency or merits of the proposed amended pleading, or any additional allegations that may be included pursuant to this ruling.
This matter will be heard in department 505 by the Honorable Michelle Tong at 1:30 p.m. per the order of the presiding judge. =(501/MT)
