DEFENDANT AUTOMOTIVE CLINIC INC.'S MOTION TO STRIKE AMENDED COMPLAINT is GRANTED in part, as to Paragraph 12 only. Paragraph 12 is stricken as false and improper, as this action is currently classified as unlimited jurisdiction, not limited jurisdiction. The motion is otherwise DENIED.
The Court notes that the Orders on the previous demurrers to the challenged pleading are already effective in their own right, and do not require further order to become effective. This matter will be heard in department 505 by the Honorable Michelle Tong at 1:30 p.m. per the order of the presiding judge. =(501/MT)
