PLAINTIFF ZELKO SIMONI, RENEE SIMONI MOTION FOR SUMMARY JUDGMENT / Notice Of Motion For Summary Judgment is DENIED.
Plaintiffs have not met their initial burden of showing they are entitled to judgment as a matter of law because they have not shown that the tenancy of Stephanie Lomas was terminated. Plaintiffs provide no authority for their assertion that the tenancy terminated by operation of law when Plaintiffs learned that Stephanie Lomas was not physically residing in the premises.
This matter will be heard in department 505 by the Honorable Michelle Tong at 1:30 p.m. per the order of the presiding judge. Prevailing party to prepare an order in compliance with CCP 437c(g). (MT)
