PLAINTIFF DELAWARE LAKEWOOD APARTMENTS, LLC Motion For Monetary Judgment is DENIED.

The declaration of Plaintiff's agent states under penalty of perjury that Defendant breached the Stipulation by failing to pay the September 2025 installment. However in reply Plaintiff admits that the payment was timely tendered, and was rejected by Plaintiff. These are materially different factual situations. The Court therefore declines to enter judgment based upon the statements in the declaration of Plaintiff's agent.

This matter will be heard in department 505 by the Honorable Michelle Tong at 1:30 p.m. per the order of the presiding judge. (MT)
