By his motion to strike, Scot Williams seeks to strike the Petition for Settlement of First Account Current, Trustee Compensation, Determination of Loan, Determination of Damages, and Repayment of Loan (the Accounting; ROA 262) filed by trustee Bret Williams on February 25, 2026. The motion to compel joint accounting seeks to compel Bret Williams to jointly file an accounting with Scot Williams. The motions are based on Scot Williams’ belief that because he was a co-trustee during a portion of the time covered by the Accounting, any accounting filed without his input is insufficient. This belief is incorrect because Scot Williams is no longer a trustee. He was removed as co-trustee by order of this court on June 5, 2025 (ROA 18).
“[T]he trustee” of a trust is the person tasked with the responsibility of providing an accounting for that trust. (Prob. Code, § 16062.) Bret Williams is the trustee of the relevant trust and was, therefore, responsible for filing the Accounting. Scot Williams is no longer a trustee of the relevant trust and had no responsibility for filing the Accounting.
The issues and concerns Scot Williams raises in his motions to strike and to compel joint accounting are appropriate for objections to the Accounting so they could be considered at any evidentiary hearing on the Accounting. They are not, however, proper bases for either motion.
The motions are DENIED.
