Ruling
The motion to vacate dismissal filed by plaintiff Warren Lieberman (Plaintiff) is GRANTED. (Code Civ. Proc., § 473(b).) The law favors judgments on the merits. Thus, on a motion for relief from default or dismissal, “doubts must be resolved in favor of relief, with an order denying relief scrutinized [on appeal] more carefully than an order granting it.” (Lasalle v. Vogel (2019) 36 Cal.App.5th 127, 134 [emphasis in original].)
The Court finds the request is timely made and there is good cause to grant the relief requested. The Court also notes the Complaint in this matter alleges Plaintiff “is an individual, residing in the City of Irvine, County of Orange, in the State of California.” (Compl., ¶ 1.) Venue in this court thus appears proper.
Accordingly, the motion is GRANTED.
The dismissal of this matter entered June 13, 2025, is hereby VACATED.
A Case Management Conference will be scheduled at the hearing on this matter.
