Ruling
Respondent John Abraham’s (“Abraham”) Motion to Terminate Receivership (“Motion”) is DENIED.
Abraham has provided no legal basis in the Motion which would permit the court to grant the requested relief. The only case citation in Motion were to City of Santa Monica v. Gonzalez, without any reference or page numbers. The only cases under that name which the court located do not contain the language allegedly cited. The only code section cited in the Motion was California Rules of Court Rule 3.1182, which only requires the receiver to provide monthly reports to the parties; those reports have been filed with the court since the receiver was appointed. (ROA 127, 134, 152, 184, 215, 224, 242, 257, 284, 309, 328, 352, 390.) Neither citation supports the requested relief.
Finally, even though the subject property appears to have been rehabilitated, the court has authorized the receiver to list and sell the property (ROA 304), which is in progress. As the receiver appears to be in compliance with this court’s orders, and as Abraham has not provided a legal basis for the Motion, the Motion is DENIED.
Court appointed receiver Richardson Griswold, Esq., is ordered to give notice of the ruling.
