First and Final Account and Report of Administrator and Petition for Final Distribution
CASE NUMBER: 24PB-0032737 This matter is on calendar for hearing on the First and Final Account and Report of Administrator and Petition for Final Distribution. The matter has been properly noticed with proof of service on file. No objections have been raised. The Court notes an acceptance or rejection of the creditor’s claim was not filed in compliance with Probate Code Section 9250 regarding the creditor’s claim filed on June 16, 2025. However, a satisfaction of claim was filed on June 23, 2026, and will be accepted by the Court as an allowance of the claim. The Court notes statutory compensation was incorrectly calculated. The compensation requested is lower than what is permitted by statute, therefore the defect may be overlooked. The Petition for Final Distribution is GRANTED. A proposed Order has been submitted and will be executed by the Court.
The Court notes the matter is set on July 20, 2026, for hearing an Order to Show Cause Re: Monetary Sanctions issued to the Personal Representative and Counsel for failure to timely close the estate administration and failure to file a Status Report as ordered on February 9, 2026, and March 30, 2026. Counsel has submitted a response to the Order to Show Cause. In light of the Petition and response, the Court will VACATE the Order to Show Cause and hearing date of July 20, 2026. This matter is set for Monday, August 31, 2026, at 2:30 p.m. in Department 44 to confirm the filing of Receipts and a Petition for Final Discharge. No appearance is necessary on today’s calendar.
