Plaintiff Delma Lamar Jefferson has filed a notice of motion and motion to vacate the arbitration award in part or in whole. Jefferson also asks the court to confirm certain nonmonetary terms of the arbitration proceedings. The court exercises its discretion to consider the motion; defendant James River Insurance Company contends it was untimely filed and served but demonstrates no prejudice.
Jefferson and James River engaged in arbitration, and the arbitrator issued a final award on March 5, 2026. (Claimant's App., vol. 1, at pp. 0147-0167.) The arbitrator awarded Jefferson $635,135.73. (Id., at p. 0167.) The award came after five days of arbitration proceedings. (Id., at p. 0150.) Liability was stipulated; the issue in the proceedings was damages. (Opening Br. at 9:2.)
Jefferson contends that he was denied the opportunity to present a portion of his damages case when he was unable to present redirect after defendant James River's cross-examination of him. (Opening Br. at 8:12-15 [citing APP 0166-0167; APP 0566-0580, 0870-0871].) He also raises issues about James River's expert disclosures.
The court concludes that Jefferson has not shown a basis for vacatur of the award. Nor does he offer grounds for correction. The court therefore confirms the award. (Code Civ. Proc., section 1286.) James River shall provide a proposed judgment. (The Court's complete tentative ruling was emailed to the parties.)
