In The Matter of Betty J. Dondero 25PR000252
MOTION FOR LEAVE TO FILE FIRST AMENDED PETITION
TENTATIVE RULING: The motion is GRANTED IN PART. Petitioners Sharon Reader and Robert Dondero are granted 10 Court days’ leave to file a First Amended Petition in substantially the same form as that attached to the Joint Stipulation and Proposed Order Granting Petitioners Leave to File First Amended Petition, lodged with the Court on June 22, 2026. The request for an order deeming the First Amended Petition filed is DENIED.
Petitioners move, pursuant to California Code of Civil Procedure sections 473 and 576, for leave to file a First Amended Petition. Petitioners further move for an order deeming the First Amended Petition filed on the date this motion is granted by the Court.
The Court finds that Petitioners have complied with the requirements of Rules of Court, rule 3.1324, subdivisions (a) and (b). (See Declaration of John P. Einwechter and Exhibit attached thereto.) On June 22, 2026, the parties submitted to the Court a Joint Stipulation to the requested filing of the First Amended Petition. Based on the foregoing, the request for leave to file a First Amended Petition is GRANTED.
However, for file management reasons the Court does not permit operative pleadings to be filed as attachments to other documents. Petitioners’ request for an order deeming the First Amended Petition filed is, therefore, DENIED.
