DEPARTMENT 414 LAW AND MOTION RULINGS

et al. v. 309 Westlake Investors Monday May 18, 2026 [TENTATIVE] ORDER GRANTING THE MOTION TO BE RELIEVED AS COUNSEL (3141) Viterbo Valera, Esq./Friedman & Chapman, as counsel for Plaintiff, Emerson Arcenio Renderos, requests an order to be relieved as counsel of record due to lack of communication and cooperation by client. Counsel served the motion on the client by mail but has not been able to confirm the address is current for the last 30 days. Counsel called the client’s last known telephone number, but the number is not in service. (Valera decl., ¶ 4.) Counsel files a supplemental declaration describing the efforts to locate the client, which included hiring an investigator to search three databases and talking to relatives, but has not been able to confirm a recent address. Counsel has filed a proof of service showing compliance with Code Civ. Proc., § 1011 ["If the party's residence is not known, any attempt of service pursuant to this subdivision may be made by delivering the notice or papers to the clerk of the court, for that party."].) Accordingly, the motion is GRANTED. Home -->)" -->
