Re: Timed Out LLC v. Copa Cabana Entertainment, LLC Superior Court Case No. 23CECG02585

Hearing Date: April 30, 2026 (Dept. 502)

Motion: By Plaintiff to Compel Further Responses to Requests for Production and Special Interrogatories and for Monetary Sanctions

Tentative Ruling:

To take the matter off calendar for failure to file moving papers.

Explanation:

Plaintiff has filed an incomplete motion, consisting only of declarations. A motion must consist of 1) notice, 2) the motion itself, 3) a memorandum, and 4) any other supporting documents. (Cal. Rules of Ct., rule 3.1112.) Additionally, while plaintiff requested a hearing date for motions to compel further responses, and previously requested a pretrial discovery conference consistent with Local Rule 2.1.17, the declarations appear to indicate the appropriate request would be to compel initial discovery for lack of responses. (Code Civ. Proc., § 2030.290.)

Pursuant to California Rules of Court, rule 3.1312(a), and Code of Civil Procedure section 1019.5, subdivision (a), no further written order is necessary. The minute order adopting this tentative ruling will serve as the order of the court and service by the clerk will constitute notice of the order.
