The petition is granted, letters of administration with full authority shall issue, bond is set at $113,460.54, Jane Dolan is appointed as probate referee and a final distribution hearing is set for Estate of April 27, 2027 at 9:00 a.m. In the event the administrator is unable to file the petition for final 9:00 26PR00098 Freeman, Daniel distribution seven (7) days prior to the final distribution hearing, the administrator shall file a status II update seven (7) days prior to the hearing. Based on the information presently before the Court, while the Petition is seeking to Probate Decedent's Will "with Will Annexed", that is not the correct Petition, as the Petitioner is a named Executor and seeks to act in that capacity. See, Probate Code §8440. Therefore, the Court requires an Amended Petition. The Amended Petition needs also to include information regarding bond in paragraphs 2.d. and 3.e., which are incomplete in the Petition presently before the Court. As to Estate of Objector Thomas Lynn Plymesser's "Petition to Remove Executor; Request for Suspension of Powers; 9:00 26PR00110 Plymesser, Request for Accounting; Objection to Probate and/or Appointment of Executor", the Court notes that Thomas H removal is premature as there has been no appointment by the Court. The Court thus deems the Petition an Objection to the appointment and a contest of the Will (as there are allegations as to the validity of "any instrument advanced by Teri"). The Court further notes that to the extent the Objector seeks a ruling in relation to any Trust document, that issue is not properly before the Court in this Estate matter, and any relief in regard thereto is denied. This matter is continued to June 23, 2026 at 9:00 AM for the filing of an amended petition.
