The following must be submitted: Supplement re: Attorney's fees. This account was simple, and straight forward, and appears to have been compiled by an accountant paid out of the estate. Therefore, explanation is required to justify the $5,547.75 fee request. The descriptions of the work performed reveal that most of the work being billed was for work that was clerical, not legal in nature.
The rate this court usually allows for clerical work is $65 per hour. The supplement must show cause why the Court should approve any fees above $3,245. Furthermore, Overhead costs are not reimbursable. The supplement should also subtract any "overhead" costs from the costs request, that are in violation of Local Rule 1732(b). ("The following expenses are considered by the court to be a business expense and are not ordinarily reimbursable costs or fees: Photocopy expenses; Telephone charges; Computer research fees; Clerical services; Travel to and from court; and Communication with the probate examiner and/or attorney."
