Preliminarily, notice appears to be technically deficient. CCP 1005 requires a minimum of 16 court days’ notice, and that period is extended by an additional 2 court days when service is by e-mail. Here the proof of service indicates the moving papers were emailed on March 30. Factoring in the March 31 Court Holiday, notice appears to be one court day short. The Court is inclined to grant the motion provided Defendant appears at the hearing and waives the notice issue. The Court would then sign the proposed order, scheduling a compliance hearing for January 27, 2027 at 9:00am. Counsel shall file a status report concerning any unclaimed funds no later than Janaury 6, 2027.
