Matter on calendar for Wednesday, June 17, 2026, Line 5, DEFENDANT AMIN SAMADIAN's Motion To Vacate Default And Default Judgment.

Defendant Amin Samadian's motion to vacate entry of default and default judgment is denied. Samadian contends that he did not receive personal service or actual notice of this lawsuit. The process server's declaration states that Samadian was personally served at his business address on January 22, 2025. Samadian provides a declaration stating that he was not present at that address on that day and did not personally receive the summons and complaint. (Samadian Decl., para. 5.)

The court does not find the Samadian Declaration to be credible: it states that Samadian "did not learn that a default and default judgment had been entered until that December 2025 date." (Samadian Decl., para. 13.) But plaintiff Pawnee Leasing Corporation provides evidence that Samadian was in correspondence with its attorney about the judgment in September 2025. (Adams Decl., Ex. 1.) Because the court credits the declaration of the registered process server and does not credit the Samadian Declaration, it concludes that the plaintiff has carried its burden of showing that service was proper.

Counsel for the prevailing party is required to prepare a proposed order which repeats verbatim the substantive portion of the tentative ruling and must email it to contestdept301tr@sftc.org prior to the hearing even if the tentative ruling is not contested.

The court no longer provides a court reporter in the Law & Motion or Discovery Department. Parties may retain their own reporter, who may appear in the courtroom or remotely.
