NOTICE:
Consistent with Local Rule 1.06(B), any party requesting oral argument on any matter on this calendar must comply with the following procedure:
To request limited oral argument, on any matter on this calendar, you must call the Law and Motion Oral Argument Request Line at (916) 874-2615 by 4:00 p.m. the Court day before the hearing and advise opposing counsel. At the time of requesting oral argument, the requesting party shall leave a voice mail message: a) identifying themselves as the party requesting oral argument; b) indicating the specific matter/motion for which they are requesting oral argument; and c) confirming that it has notified the opposing party of its intention to appear and that opposing party may appear via Zoom using the Zoom link and Meeting ID indicated below. If no request for oral argument is made, the tentative ruling becomes the final order of the Court.
Unless ordered to appear in person by the Court, parties may appear remotely either telephonically or by video conference via the Zoom video/audio conference platform with notice to the Court and all other parties in accordance with Code of Civil Procedure §367.75. Although remote participation is not required, the Court will presume all parties are appearing remotely for non-evidentiary civil hearings.

A Stipulation and Appointment of Official Reporter Pro Tempore (CV/E-206) is required to be signed by each party, the private court reporter, and the Judge prior to the hearing, if not using a reporter from the Courts Approved Official Reporter Pro Tempore list.

Defendant County of Sacramentos motion for summary judgment/adjudication is both pursuant to Code of Civil Procedure §437c(h) and the Courts own motion CONTINUED to 7/7/2026 at 1:30 p.m. in this department.
Plaintiff may file and serve supplemental opposition papers and defendant County may file and serve a reply to any supplemental opposition by plaintiff in conformity with the deadlines set forth in Code of Civil Procedure §437c(b)(2) and (4), respectively, based upon the continued hearing date of 7/7/2026.
The Court is cognizant that this order requires plaintiff to file and serve supplemental opposition papers, if any, imminently given the 20-day deadline in §437c(b)(2) based upon the 7/7/2026 continued hearing date. This continuance under §437c(h) is made solely upon the presumption that plaintiff is already in possession of additional evidence she sought to include in the earlier opposition but simply did not have such evidence at the time she filed her original opposition.
This continuance is not based upon any premise that plaintiff should be allowed to hereafter conduct and/or obtain additional discovery in order to include it in any supplemental opposition. In this regard, the Court notes that trial is currently set for 7/13/2026 and plaintiff, by letter dated 5/29/2026, withdrew her motion to continue trial which had been set for 6/26/2026. Given that non-expert discovery has already closed in relation to the 7/13/2026 trial date (even assuming discovery deadlines are calculated on the present trial date rather than the original trial date in 2025) and no motion has been made or granted to extend or reopen discovery, the Court finds unavailable to plaintiff any argument that this motion for summary judgment/adjudication should be

continued based upon §437c(h) due to any asserted need to conduct additional discovery in the future to oppose this motion.
In any event, given the limited amount of time available between the current 6/16/2026 hearing date and the 7/13/2026 trial date, there is insufficient time to allow for not only the completion of additional discovery but also the submission of supplemental opposition and reply papers, while still affording this Court with a reasonable opportunity to review and consider such supplemental papers and to prepare a tentative ruling.
Moving party to provide notice of this ruling and file proof of service of same within five (5) court days.
