NOTICE:

Please take notice, effective April 13, 2026, Department 54 has moved to Department 16C at the Tani G. Cantil-Sakauye Courthouse. The Honorable Christopher E. Krueger remains presiding over all Home Court proceedings, including Case Management and Law & Motion. All hearings currently scheduled or reserved after the effective date shall remain in place and will be heard in Department 16C.

Tentative Ruling
On the Court's own motion, the Hearing on Motion - Other for Default Judgment scheduled for 05/07/2026 is continued to 05/21/2026 at 09:00 AM in Department 16C at Tani G. Cantil- Sakauye Courthouse.
The Court has adopted the following procedure for hearings in Department 16C for selfrepresented incarcerated parties.
The clerk shall fax a copy of the tentative ruling to the litigation coordinator on or before the date of the scheduled hearing. The litigation coordinator shall provide the tentative ruling to Plaintiff Phillip James Colwell (Plaintiff) within 48 hours of receiving it.
The hearing date shall automatically be continued two weeks for oral argument. The continuance date will always be an appearance required hearing so that Plaintiff need not request oral argument.

Pro per Plaintiffs application/motion to enter default judgment against Defendant Michael Aye (Defendant) is DENIED.
As explained previously by the Court, Defendant has filed a demurrer which precludes default from being entered. (See Notice of Rejection Request for Default/Judgment, March 23, 2026; Minute Order, May 22, 2024.)
Additionally, since Defendant has appeared in the action, Plaintiff was required to provide Defendant notice of the hearing. CRC Rule 3.1112(a) requires that a motion must include a notice of hearing, the motion itself, and a memorandum of points and authorities. A notice of hearing must state, among others, [t]he date, time, and location, if ascertainable, of any scheduled hearing and the name of the hearing judge, if ascertainable. (CRC Rule 3.1110(b)(1).) Plaintiff failed to file and serve a notice of motion with todays hearing date. As a result, Defendant was not given notice of todays hearing date. Defective service deprives the court of jurisdiction to act. (Lee v. Placer Title Co. (1994) 28 Cal.App.4th 503, 509.)
Additionally, CRC Rule 3.1112(a) and Rule 3.1113 require a memorandum of points and authorities. No memorandum of points and authorities was filed or served.
This minute order is effective immediately. No formal order or other notice is required. (Code Civ. Proc. §1019.5; CRC Rule 3.1312.)

Parties requesting services of a court reporter will need to arrange for private court reporter services at their own expense, pursuant to Government code §68086 and California Rules of Court, Rule 2.956. A Stipulation and Appointment of Official Reporter Pro Tempore (CV/E-206) is required to be signed by each party, the private court reporter, and the Judge prior to the hearing, if not using a reporter from the Courts Approved Official Reporter Pro Tempore list.
Once the form is signed it must be filed with the clerk. If a litigant has been granted a fee waiver and requests a court reporter, the party must submit a Request for Court Reporter by a Party with a Fee Waiver (CV/E-211) and it must be filed with the clerk at least 10 days prior to the hearing or at the time the proceeding is scheduled if less than 10 days away. Once approved, the clerk will forward the form to the Court Reporters Office and an official reporter will be provided.
