The motion of Defendant California Correctional Health Care Services (Defendant) to continue trial is ruled on as follows.
Trial is currently scheduled for March 16, 2026. Defendant requests a continuance of trial. Defendant argues there is good cause for a continuance because the parties have been unable to complete discovery despite diligent efforts, the parties wish to participate in mediation, and Defendants Counsel has conflicts with the current trial date.
Plaintiff agrees a continuance is appropriate. However, Plaintiff objects to Defendants request that all statutory deadlines should be based on the new trial date. Plaintiff argues there is an ongoing dispute as to the existence and enforceability of a stipulation to modify the deadline for a motion for summary judgment and that the Courts order should therefore exclude language extending statutory deadlines.
The Court finds good cause for a continuance based on the agreement of the parties, the need for additional time to complete discovery, the desire of the parties to participate in mediation, and Defendants Counsels unavailability for trial due to conflicts. The February 3, 2026 MSC and March 16, 2026 trial dates are VACATED.
Trial is set for July 21, 2026 at 8:30 a.m. in Department 47. A mandatory settlement conference is set for June 1, 2026 at 9:30 a.m. in Department 59.

All trial related and discovery deadlines shall be governed by the new trial date. Nothing in this order limits the ability of the parties to stipulate to alternative deadlines, nor does this order affect any prior agreements to modify such deadlines.
This case has been assigned to Department 47 for hearing. In the event that either party requests a hearing the matter will be heard at 9:30 a.m. in Department 47. Any party requesting an oral argument must contact the clerk at (916) 874-5487 and opposing counsel or parties in pro per by 12:00 p.m. on the court day before the hearing. If a proper request for hearing is not made, this shall become the order of the Court.
Parties requesting services of a court reporter will need to arrange for private court reporter services at their own expense, pursuant to Government Code section 68086 and California Rules of Court, rule 2.956. If a litigant has been granted a fee waiver and requests a court reporter, the party must submit a Request for Court Reporter by a Party with a Fee Waiver (CV/E-211) and it must be filed with the clerk at least 10 days prior to the hearing or at the time the proceeding is scheduled if less than 10 days away. Once approved, the clerk will forward the form to the Court Reporters Office and an official reporter will be provided.
