NATURE OF PROCEEDINGS: REQUEST FOR ORDER – CHILD SUPPORT
Juan Carlos Ruiz De La Torre (Father) filed a post-judgment request for order (RFO) seeking to modify his child support obligation based on the changed circumstances of his lack of employment. He personally served Mother with the RFO; Mother has not responded to the RFO.
Father seeks to modify the child support orders contained in the parties’ 5/29/2019 Judgment, ordering Father to pay child support to Crystal C. Ramirez (Mother) in the amount of $765 per month, effective 5/17/2019. The 5/29/2019 Judgment is based on Father’s income of $5,547 per month, Mother’s income of $1,500 per month, and Father’s 28% custodial timeshare with the minor child Jeancarlos Ruiz Ramirez, born 9/21/2011.
In his RFO, Father asserts that circumstances have changed. Father asserts he is now unemployed and he has a new family, with two children.
In his Income and Expense Declaration, Father asserts that his employment with Alameda Point Redevelopers ended in August 2025. Father’s 2025 tax return confirms that Father is filing a joint return with his new spouse and has two additional children. Father provides no estimate of Mother’s income.
The Court’s child support calculation reflects zero income for Father and his Married Filing Jointly tax filing status. In the absence of any information regarding Mother’s income the Court will utilize zero income for Mother. Based on the foregoing information, child support is set at zero, effective April 1, 2026, and continuing until further court order, until the child marries, dies, is emancipated, reaches age 19, or reaches age 18 and is not a full-time high school student, whichever occurs first. See calculation attached as Exhibit A.
As authorized by CRC Rule 5.125, the Court shall prepare the formal Findings and Order After Hearing.
