Conservatorship of Cecilia Vital

Appointment of a Conservator in this state and to the court supervising the conservatorship. There is no proof of service for the court supervising the conservatorship in Wisconsin and service was made only 5 days prior to the hearing. Probate Code Section 2014 does not provide the Court with discretion to shorten the notice period and Petitioner has not provided any authority that would allow the Court to do so. The Application is DENIED. A proposed Order was lodged and will be modified to reflect the Court’s ruling. No appearance is necessary on today’s calendar.

CONSERVATORSHIP OF CECILIA VITAL CASE NUMBER: 26PC-0033237 This matter is on calendar for further proceedings on a Petition for Appointment of a Conservator of the Person and Estate. The Court notes this matter is filed pursuant to an order for transfer from Clark County, Nevada. No further documents have been filed to address the issues regarding service raised on April 20, 2026. This matter was previously continued to allow Counsel to provide what documents he has from the out-of-state doctor to the Court Investigator. A document in support of the Petition has been filed which sufficiently the issues regarding a Capacity Declaration and report of the assessment by the regional center. The Court Investigator’s report filed on March 6, 2026, indicates that the proposed Conservatee will not attend the hearing. The Court Investigator recommends granting the Petition.

The matter is continued to Monday, July 27, 2026, at 2:30 p.m. in Department 44 for further proceedings regarding the Petition for Appointment of a Conservator of the Person and Estate. A second amended Petition is required to be filed to address the issue raised above. Petitioners are required to file and serve a new Notice of Hearing for the continued hearing date, along with a copy of the second amended Petition, on all parties entitled to notice. A new Citation for the continued hearing date is required to be issued and served on the Conservatee. A Capacity Declaration is required to be filed. The report of the assessment from Far Northern Regional Center is required to be filed. No appearance is necessary on today’s calendar.
