Tentative Ruling

Counsel Bruce Timm on behalf of Boutin Jones, Inc., seeks to be relieved as counsel for Defendants Nor Cal Taco, Inc., dba Chandos Tacos Fair Oaks, Chandos Roseville, Inc., Chandos Elk Grove, Inc., and Chandos Citrus Heights, LLC (Defendants). Counsel attests that Defendants failure to effectively communicate with counsel has rendered it unreasonably difficult to carry out representation and made it impossible for counsel to continue representing Defendants. (Timm Decl., ¶ 2; Attachment 2.)
Counsel attests that he served Defendants by mail at their last known address. (Id., ¶ 3(a)(2).) Counsel explains that he sent an email correspondence to the owner of Defendants, Lisandro Madrigal, on August 29, 2025, confirming the service addresses for the agents for service of process for all Defendants [and] copied two other representatives of Defendants on that email, Xiomara Madrigal and Joey Heredia. While [Counsel] did not receive a response, Defendants are aware this motion is being filed and will also receive a courtesy copy of the motion via email. (Id., ¶ 3(b)(1)(d).)
Counsels description fails to explain how he confirmed the addresses for Defendants agents for service of process as current when he did not receive a response. Accordingly, the Parties APPEARANCE IS REQUIRED and Moving Counsel shall be prepared to provide additional explanation.
Counsels motion to be relieved is UNOPPOSED and GRANTED, subject to Counsels supplemental explanation. The Court will sign the Order submitted with Counsels moving papers.

If you are not using a reporter from the Courts Approved Official Reporter Pro Tempore list, a Stipulation and Appointment of Official Reporter Pro Tempore (CV/E-206) must be signed by each party, the private court reporter, and the Judge. The signed form must be filed with the clerk prior to the hearing.
If a litigant has been granted a fee waiver and requests a court reporter, the party must submit a Request for Court Reporter by a Party with a Fee Waiver (CV/E-211). The form must be filed with the clerk at least 10 days prior to the hearing or at the time the hearing is scheduled if less than 10 days away. Once approved, the clerk will forward the form to the Court Reporters Office and an official reporter will be provided.
